Pledge of Allegiance to the Flag PUBLIC HEARING: Water Rates: The town was presented with a water rate increase of 68%. Everything was broken down for them to better understand. After a short discussion the ordinance was read for the first time. Approve Budget: Council Member Michael Johnson made the motion to approve the budget. Council Member Darwin Miller seconded the motion. Motion carried 3-1 with Council Member Jerry Leitz abstaining due to being out of town and not seeing the budget. Closed Public hearing Open Council Meeting: Approve minutes or memoranda: August 15,2023. Council Member Darwin Miller made the motion to approve the minutes. Council Member Michael Johnson seconded the motion. Motion carried 4-0 Approve the Financials: 1. Department Heads reports: Jeff Province: Wastewater/Stormwater-Windows have been ordered for the wastewater lab. Still having issues with the clarifiers. Robert Thomas: Water/Street- Council Member Darwin Miller asked Bob to look at the drain behind the store. The streets will be finished this week. The question was asked why the sidewalks didn’t come to the street? Bob said he didn’t know but would talk to the engineer. Marshal Baer: Town Marshal-Car is out of the shop. Getting it ready to sell either as a police car or stripped-down public car. Monthly reports. They are starting to make more traffic stops due to the traffic in town. The Crosswalk signs are out and things are going pretty well. There is not an ordinance on poultry in town and would like to have one made so that it is clear what the residence can have in town. Lori Bussell: Park Board- Matt Hall gave the park report. They have paved one side of the park drive and the parking lot. They are going to be installing speed bumps soon. The other half of the drive is on the agenda for the summer of 2024. Park meetings are on the 4th Wednesday of the month. Jacob Ahler: Town Attorney- no report Pamela Bennett: Clerk-Treasurer-no report Old Business: Bids for storage room: There were two bids turned in for the storage room. Ron McClure Construction gave a bid of $5172.00. Kevin Sutton Construction gave a bid of $4800.00. Council Member Michael Johnson made a motion that we accept the bid from Kevin Sutton construction. Council Member Rex Pearson seconded the motion. Motion carried 4-0 Air conditioner: The air conditioner has been out for two weeks. Chris Ruemler Heating and Cooling recommends that the unit be replaced. The quote was for $4800.00. Council Member Michael Johnson made the motion to replace the unit. Council Member Rex Pearson seconded the motion. Motion carried 4-0 Compost Bins: There were 3 bids turned in for new compost bins. Reith-Riley had a bid of 64,000.00. Cowboy Excavating had a bid for $27,800.00 and Steve had a bid for $25,000.00. Council Member Darwin Miller made the motion to approve the bid from Steve for $25,000.00. Council Vice President seconded the motion. Motion carried 3-1 Council Member Michael Johnson said he felt it was a waste of money and unnecessary. New Business: Resident’s comments: Please keep it to 5 minutes. Resident Robin Foley: They are worried about flooding with the new street being so high. It is the same way on Johnson and 4th St. Cameron is going to go and look at the issue and call the Engineer. George Matthew: Drain on Burke and Market can’t drain because it is too high. Susie Minnear: 4th St. When it rains it floods yards and homes. Would like the drain and pipes to be looked at and taken care of, please. Residents are upset and ready to go to the state and not pay their water bills. The Council is on the agenda for the Commissioners meeting Oct 2 at 8:30 and will have this in the proposal. Vice President Jerry Lietz told us about forestry grants. Resident Mark Bachman: Brought in a bottle of water to show the council. The water in the bottle was before they had flushed the hydrants. Mr. Bachman was told that he will be getting a letter from IDEM. Adjourn

Motion carried 3-0 Resident’s comments: Resident Mark Bachman wanted to know when the hydrants were going to be flushed? It has been delayed due to the new sidewalks and streets going in. ORDINANCE No. 2022-02-013-____ TOWN OF WOLCOTT ORDINANCE FIXING THE MILEAGE RATE FOR THE OFFICERS AND EMPLOYEES OF THE TOWN OF WOLCOTT, INDIANA FOR THE YEAR 2022 WHEREAS, the Town of Wolcott is desirous of reimbursing Town Officers and Employees for travel expenses when on official town business; and WHEREAS, the State Board of Accounts has established an audit position of allowing reimbursement based on actual miles traveled in personal motor vehicles on official business if a reasonable rate per mile is fixed by ordinance or resolution; and WHEREAS, the town of Wolcott authorizes reimbursement for use of a personal vehicle in the conduct of official Town business at mileage rates as allowed by the U. S. Internal Revenue Service; and WHEREAS, the U. S. Internal Revenue Service fixed the standard mileage rate for the use of a car (including vans, pickups, or panel trucks) at .58.5 per mile for business miles driven from January 1, 2022 through December 31, 2022. NOW, THEREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL OF WOLCOTT, INDIANA, that: 1. The mileage rate for reimbursement for use of a personal vehicle in the conduct of official Town business is hereby fixed at .58.5 per mile during the period January 1, 2022 through December 31, 2022. 2. All Ordinances and Policies that are inconsistent with the provisions of this ordinance are hereby repealed as to the extent of such inconsistency. This ordinance shall become in full force and effect upon passage and adoption by the Wolcott Town Council. Town of Wolcott Council Workshop August 2, 2023 6:00 101 W North St. Discussed what to do about the water rates. Baker-Tilly suggested that the Council raise the rates by 75%. The Council didn’t want to go to 75%. The workshop was to determine how much we must raise the rates. After A lot of discussion and going over Water Superintendent Bob Thomas’s 2024 budget. We found that we can raise the rates 63% and still be okay with Bob’s budget. The 2024 budget was presented to the Board. There were a couple of questions. adjourn

Motion carried 4-0 With the closing of the checking account the funds need to be transferred. Pam presented resolution 2023-08-3 to transfer the funds to the wastewater checking account. Council Member Michael Johnson made a motion to Approve the resolution. Council Member Rex Pearson seconded the motion. Motion carried 4-0 Old Business: Matt Parsley: NIPSCO Tree trimming has been delayed and a new date has not been set. Ken Smith: The sidewalk on Burke has a gas line on a portion of where the new sidewalk would be put. It was talked about going further down on Burke to the North. Council member Darwin Miller made the motion to change the location of the sidewalk. Council Vice President Jerry Lietz seconded the motion. Motion carried 4-0 Annex in INARNI and Dollar General: Town Attorney Jacob Ahler gave a lot of information on what we need to do to annex. Next step is to appoint a committee. New Business: Additional Appropriation Resolution 2023-8-15 Council Member Michael Johnson made a motion to approve the Resolution. Council Member Darwin Miller seconded the motion. Motion carried 4-0 Resident’s comments: Janelle Hofstetter: Janelle called Baker-Tilly to see if we could transfer funds. We can, but there has to money to transfer. Asked if we have made an appointment with the Commissioners. We are working on the presentation. Resident Mark Bachman: Asked about the issue with the water. Water Superintendent Bob Thomas said that the company has been here. He needs to back wash 2-3 more times and flush the lines. Resident Larry Klink: Concerned about cars parking behind the café in from of some mailboxes. He wants to know if we will put up a no parking sign. Adjourn

Council Member Michael Johnson suggested that we also make an appointment with the White County Economic Development to see if there is some way that they could help as well. Budget is going extremely well, and it will be passed and adopted in September. Pamela will be on vacation from Aug 6-14. Motion Carried 3-0 Annex in INARNI and Dollar General: It was discussed that since INARI and Dollar General are using town utilities it would be great if they would volunteer to be annexed into town limits. After very little discussion, Council Member Darwin Miller made the motion to turn this over to Attorney Jacob Ahler to begin the process. Council Member Rex Pearson seconded the motion. Motion carried 3-0 Resident’s comments: Resident Sara Anifer: Sara would like to start a farmers’ market at the park in 2024. The Council said that is a great idea. Council Member Darwin Miller made the motion that it would be a good idea to have a farmers’ market. Council Member Rex Pearson seconded the motion. Motion carried 3-0. Sara will have to talk to the park board now. Water rates: The water rates are going to be discussed in a workshop meeting on Aug 2. Resident Karen Evans: Water rates. What is the truth? The truth is that Baker-Tilley “suggested” that we raise the Rates by 75%. Clerk-Treasurer Pamela Bennett explained that it is only a suggestion. She can’t see that the council would raise the rates that high. Pamela also explained that she and the council sure don’t want their water to raise that much as well. Resident Karen Deno: Karen wanted to know what was going on with the Golf Carts. Why they can’t ride on the sidewalks. It was explained that the pedestrians were complaining that Golf Carts were not stopping for them to go on through. Resident Betty Hoster asked how Darwin will get to another street without going on the sidewalk. Council President Cameron Emond did explain that Darwin can go on the sidewalk to the closest street from his to get off the sidewalks. Resident George Matthew: Asked when he is going to get the street signs on the end of his lane. It was explained to him that they are being ordered. Resident Betty Hoster said that she would like to see slow signs on some of the town streets. Especially at the corner of North and Davis where kids are always playing. Council President Cameron Emond adjourned.
- Ordinance - Increase of Council Members
Ordinance No. 2006-04 An Ordinance to Increase the Number of Council Members and to Redistrict the Town for Election Purpose WHEREAS, the Town of Wolcott has been divided into districts for the purpose of conducting elections of Town officers, first by the Board of Commissioners of the County of White when the Town was incorporated, and subsequently by the legislative body of the Town; WHEREAS, the Town Council is the legislative body of the Town of Wolcott by the virtue of Indiana Code Section (I.C. 36-5-2-4.1); WHEREAS, the Council of the Town of Wolcott has, at a public meeting of the Council, provided an opportunity for all members of the Council and voters of the Town of Wolcott to comment and make suggestions concerning the division of the Town of Wolcott into legislative districts under this Ordinance; WHEREAS, in the latest General Election, a majority of registered voters residing within the corporate boundaries of the Town of Wolcott elected to increase the number of members serving on the Council from three to five, as provided by IC 3-10-9-4; and WHEREAS, the Council of the Town of Wolcott has determined that the legislative district boundaries should be removed. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF WOLCOTT, INDIANA: Section 1. The Council of the Town of Wolcott hereafter consists of five (5) at-large members. Section 2. All at-large Council members shall reside within the Town of Wolcott corporate boundaries. All five Council members shall be elected at-large by all registered voters residing within the corporate boundaries of the Town of Wolcott. Section 3. The Council of the Town of Wolcott has determined that the legislative body shall be elected by the voters of the whole town. Section 4. The members of the Council of the Town of Wolcott shall serve staggered terms of office as follows: (a) Three (3) at-large members of the legislative body are elected during a year that municipal elections are held under IC 3-10-6-5, specifically commencing 2007, and each four years thereafter; (b) Two (2) at-large members of the legislative body are elected during the year after the year described in subdivision (a) during the General Election that year. (c) The Council shall appoint qualified members to fill in a newly created or otherwise vacant council members’ seats and each appointee shall serve until the next election, and until his or her elected successor has qualified and taken office. The term of each elected member of the town legislative body shall be a period of four (4) year. No appointment shall exceed four (4) years. (d) The term of each town officer begins January 1 after the election. Section 5 The Clerk-Treasurer of the Town of Wolcott shall forward a signed copy of this Ordinance to the Clerk of the Circuit Court ofWhite County and shall request the Clerk to include the copy of this Ordinance in the records of the White County Election Board. PUBLIC HEALTH AND SAFETY ORDINANCE NO. 3-2001 OPEN BURNING REGULATION WHEREAS, the Common Council of the Town of Wolcott has the authority to propose and adopt ordinances to improve the health and safety of its citizenry and real property; and, WHEREAS, the burning of leaves and other residential rubbish has, in the past, been tolerated as a means of trash disposal; and, WHEREAS, in recent years the Town of Wolcott has improved upon its trash pickup provided to the citizenry of the Town of Wolcott including regular pick-up and disposal of yard waste, including leaves and trimmings; and, WHEREAS, burning of yard waste, including leaves and residential trash, generates smoke by which, in its nature contains pollutants and contaminants to the environment that are harmful to the health of the citizenry of the Town of Wolcott; and, WHEREAS, the health and safety factors far out weigh the traditional tolerance of burning as a means of trash disposal; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the Town of Wolcott, White County, State of Indiana, as follows: 1. That no person shall start, kindle, cause, allow or maintain any form of burning of leaves, grass, brush, wood of any kind, or the burning of trash, rubbish or garbage, waste oil, tires, paper or wash on private or public property within the Town of Wolcott, except as specifically authorized by this Ordinance; PUBLIC PROPERTY as used in this section shall include any public street, alley, road or other public ground; PERSON as used in this section shall include individuals, firms and corporations, together with their officers and employees; 2. That the Indiana Fire Safety Code enacted pursuant to IC 22-13-1 et sq. is hereby adopted as the town fire code, and that all open burning must comply with the regulations controlling open burning promulgated by the Indiana Air Pollution control Board (326 IAC). 3. That the Fire Chief or Town Marshal may prohibit any and all bonfires or outdoor rubbish fires whenever he deems atmospheric conditions or local circumstances make such fires hazardous to persons and property. It shall be unlawful for any person to disobey such order of the Fire Chief or Town Marshal. 4. That no person shall kindle or maintain any bonfire or rubbish fire or cause such bonfire or rubbish fire to be kindled or maintained on any private property or lands unless said bonfire or rubbish fire is contained in an approved waste burner as set forth in Section 7, located at a safe distance from any building, pole, fence or other structure; in any event, said burner shall not be located less than ten feet from such building, pole, fence or other structure. 5. That no person shall kindle or maintain or cause to be kindled or maintained any bonfire or rubbish fire between the hours of 7:00 p.m. and 6 a.m. During such hours no person shall leave any such fire burning; 6. That any person kindling or maintaining any bonfire or rubbish fire or any person causing said bonfire or rubbish fire to be kindled or maintained shall attend the said fire or cause said fire to be attended by a competent person until such fire is extinguished. Such person shall have the necessary means for extinguishing said fire readily available in case of need. 7. That an approved burner for the purposes of this subchapter shall have the following characteristics: a. the burner shall be so constructed so as to prevent the spread of fire outside of the burner itself; b. the burner shall be constructed of metal or masonry with four side sand a bottom so constructed as to allow no openings except for cleaning and draft, and these openings shall be so protected as to prevent the escape of sparks or fire; c. the top of the burner shall be so constructed as to allow the proper escape of smoke or gases, but shall be equipped with a spark arrestor with openings no larger than one-fourth inch so as to prevent the escape of burning material; d. that any person who constructs and uses a burner complying with the terms of Section 5 shall so construct and use said burner in such a way that it does not constitute a public nuisance; 8. That during the construction or demolition of buildings or other structures no waste materials or rubbish shall be disposed of by burning on the premises of such demolition or construction or in the immediate vicinity thereof without a written permit from Fire Chief; 9. That the following types of fire are permitted: a. customary burning of logs and other wood products in residential fireplaces; b. burning of charcoal and other food cooking fuels customarily used in outdoor grills or traditional food cooking devices; c. fire celebrating Twelfth Night Ceremonies; d. fire celebrating school pep rallies; e. fire celebrating scouting activities; f. fire used for recreational cooking purposes, i.e., campfires, BBQ grills; g. industrial and/or commercial burning through methods specifically and previously approved by the Indiana Department of Environmental management, or other appropriate state, local and/or federal regulatory agencies; h. any other type of fires whereby a citizen of the Town of Wolcott has obtained a variance from the provisions of this Ordinance by petitioning the Common Council, providing, however, that the Common Council cannot grant a variance that would otherwise violate the provisions of 326 Indiana Administrative code 4-1 et. seq., and as amended; 10. That the Open Burning Regulations be adhered as follows: a. fires shall be attended at all times until completely extinguished; b. if fires create a nuisance or fire hazard, they shall be extinguished. c. no burning shall be conducted during unfavorable meteorological conditions such as temperature inversions, high winds, air stagnation, etc.; and, 11. That any person found in violation of this Ordinance shall be subject to the following procedures: a. The Fire Chief or Town Marshal shall issue warning notice to a first-time violator stating that he or she is in violation. The person must then correct the violation by immediately extinguishing the fire. Failure or refusal to immediately extinguish a fire shall result in a citation then being issued. b. Issuance of a citation to the violator shall result in an imposition of Fifty Dollar ($50.00) fine administered by the Ordinance Violation Bureau through the Clerk of the Town of Wolcott. c. Failure or refusal by the violator to immediately extinguish the fire in violation of this Ordinance shall also result in the Wolcott Volunteer Fire Department having the authority to go upon private property to extinguish said fire. Furthermore, in such instances where a leaf or rubbish fire results in damage to property other than the violators, including damage to public property, e.g., asphalt, or results in injury to another person, the imminent threat or damage to other party's property including public property that said fire is determined to be caused by negligence and/or the willful disregard or violation of this Ordinance, a fine of the cost expended by the Town of Wolcott to send fire suppression personnel or equipment to the location shall be assessed with said fine not to exceed One Thousand Five Hundred Dollars ($1,500.00). d. Each subsequent starting, kindling, causing or allowing of a new fire after notice of violation has been issued shall be considered a separate offense. Pledge of Allegiance to the Flag Public Hearing: Ken Remenschneider- Presented the 5-Year strategic plan. The White County Area Plan is over all of the development of the 5-year Strategic plan. After Mr. Ken Presented the plan, Shawn Cain of KIRPC explained how the funding will work. The plan cost $54000.00 with a 25/75 match. She explained that the Plan had to be ok’s by OCRA before we could move forward. OCRA approved every aspect of the plan. There was a rumor that this plan was going to be annexing and taking land from our farmers. Shawn did a great job explaining that this rumor is totally false. We have no interest in annexing or taking anyone’s land. Resident Comments: Janet Gross: Is there a way that we can look at the plan in depth? Shawn did let the people know that it will be on the website after it is adopted. Kenny Burns: Voiced his opinion against the plan. He said the town is fine the way it is and doesn’t need to be changed. Shawn told Mr. Burns that she understands that change is hard on some people, but it is necessary to grow. Michael Jordan: Where is all this information? Again, it will be on the website as soon as it is adopted. He wants to know why things are getting done that need to be done and looks to do more projects. Renee’ Anker: Communication bread down is what is going on in the town. She asked how long this plan is for and how long we can apply for grants? Shawn said the plan is for 10 years and the town can apply for grants for as long as the window is open. Shawn Cain: Let the town know that there is a knew Safe roads study being done in 8 counties. This project is a study that is being done on streets and roads to see how the roads can be made safe. There are grants that can help to fix the dangerous roads. Janell Hofstetter: Had three questions. 1. Market Street parking. The parking on Main Street is going from angled to Parallel. How many parking are going to eliminate? Janell was told that this is just a plan and may not work. 2. Civic Space: Is the town going to buy the land for Civic Space? Yes, or whatever will be better for the town. 3. Future Tourist: How is the plan going to bring in tourism? The Civic Space will have a farmers Market and a space for Special Musical events. This will bring in people from the area and outer parts that will normally not come to Wolcott. Renee’ Anker: Will this plan include the fixing the streets, roads and sidewalks. The answer is yes along Market and part of Range St. There is a Community Crossing grant that will cover the other roads and sidewalks. Jeff Anker: Are you annexing land? Shawn answered, No. She went on to say that she has never annexed or done eminent domain on anyone’s land and has no plans to do so. She said it is not done quickly. There are Public Meeting after Public meeting, and this has not taken place. Nor has any property owner been notified. Council Vice President Jerry Lietz: Jerry is on the WCAP committee. He said there is a lot of rezoning going on in White County. It would take a lot to annex land. Witco abatement. Read Resolution 2023-6-6 Gabba LLC abatement. Read Resolution 2023-6-7 Mr. Rex Anderson and Ms. Valerie Fredick presented the reason for the tax abatement. This will help to provide appropriately 50 more jobs to our area. The new equipment will do three more times production than it does at this time. Council Vice President Jerry Lietz made the motion to grant the abatement. The Council told George that that would be his association that would need to take care of this problem. Resident Mark Bachman: He is having problems with this water. After a long discussion. Mark was asked to Speak to Bob Thomas, Water Superintendent. Walt Owens: He would like to have 3rd street paved. He was told that it is on the fall round of Community Crossing grant. Walt would like to have a place to take limbs and yard rubbish to burn. He was told there is nowhere for the town to burn. It would have to be taken to Bio-Town. Adjourn
