    Text Feed Minutes April 6, 2022 8:34 P.M. Council Member Rex Pearson Sent out a text in regards to the ARPA premium pay. Council Member Rex Pearson: My thoughts give all police that worked through the pandemic and Bob $2500.00 and be done with it. We should be looking at water mains that need replaced. Clerk-Treasurer Pamela Bennett stated that that was a good ideal. Council Vice President Jerry Lietz: I’m with you. Don’t see the need for offices bonuses, especially since they were closed during the worst of it. Good plan. Clerk-Treasurer Pamela Bennett: Just a reminder. No one else can comment through test. That would make this a meeting. At this point I don’t care what you all decide. I have too much. I don’t understand why people can’t be grateful for what they’re getting. I do like Rex’s idea. A gate for the ball diamond, Batting Cage, Camera System and moving all electric to one location. Steve Young Sr: Ambulance Director: No report Kenneth Burns: Volunteer Fire Department: NIPSCO had a power surge. There is approx. $2200.00 worth of damage to the Fire Station. The Storm Alert Siren was hit as well. It will still work manually. White County is aware of the system being damaged. Sandy Miller- RWCDC and Food Pantry: Food Pantry went very well. There were some upgrades made to the Wolcott Clinic. Installed a back-up generator and replaced lights in the office as well as a new water heater. Jenell Hofstetter KIRPC: No meeting in February. Jerry Lietz: Area Plan Committee: Next meeting, our downtown and the Solar Farm will be discussed. Michelle Earney: Summer Festival Committee: Asked for permission for a Beer Garden at the festival. Council Vice President Jerry Lietz made the motion to have a beer garden at the festival. Council Member Darwin Miller second the motion. Motion passed 3-0 Marilyn Maxwell: Main St Committee; Waiting for permits for the old gas station. There will be a Shop Galore on 24 again this year. Cornhole tournament at the Summer Festival and a Holiday Bazaar. Jacob Ahler: Town Attorney: He will be making an ARPA Ordinance for our plan for the ARPA grant. The ordinance will lay out what plans we have for the grant. Plans are to redo the Floor in the Fire/Ambulance station, fill in the dry well at the old water plant, and do work to the building at the old water plant. We would also like to redo the compost bin. We are also wanting to do, put in a new tile at Shirley Mills so her yard will drain. Put a tile along 4th St. so the yards will drain properly. Council Member Darwin Miller made a motion to have all the projects put in our plan ordinance. Council Vice President Jerry Lietz second the motion. Motion carried 3-0. It was talked about a resolution for Direct Standard for trees. This would cut down on all the confusion as to what the town can and cannot do as far as cutting and trimming trees around town. Council Member Darwin Miller asked about how the walnuts at the Wolcott House can be taken care of. Council Member Darwin Miller has taken it upon himself to trim the limbs and cleanup the walnuts every Year. At the advice of Town Attorney Jacob Ahler, Darwin cannot trim the trees. The Wolcott House will have to either hire someone or do the trimming themselves. Resident George Mathew said that the farm supports the Wolcott House and the trees and walnuts should be their responsibility. Pamela Bennett: Clerk-Treasurer: Clerk-Treasurer institute March 13-17 in Muncie. Council Darwin Miller made the motion to go to the Clerk-Treasurer Institute. Buy the present unit for 750.00 and keep the supply service contract-this printer. Lease a new one but I know that is not allowed for 99.00 a month Send 90-day cancellation letter and pay the 375.00 to have it picked up. After a short discussion, Council Member Darwin Miller made the motion to buy the Copier for $750.00 with a service agreement of $592.00. Council Vice President Jerry Lietz second the motion. Motion carried 3-0. Rob Bellucci CommonWealth: There is an easement out at the wastewater plant that Construction company needs an easement agreement. Town Attorney Jacob Ahler will get the info from Rob and get the agreement together. DG Water Main Replacement Ø Drill Rig Was Delivered week of 2-21-2022 Ø Pipe Scheduled for Delivery 2-28-2022 Ø We will be videoing existing sanitary to confirm location of sewer laterals Ø New WM installation scheduled to commence 2-28/3-01 Ø Once main is installed and tested; lateral reconnections will commence. WWTP Improvements Ø TCI has internal / annual safety training this week and we will coordinate schedules to find alternate date for the March 2022 construction meeting Ø CEI coordinating with funding agencies and TCI for installation of new REMC electrical service at the WWTP site. Ø CEI coordinating with funding agencies to obtain approval on new lab equipment purchases; CEI received notification from Utility staff that existing equipment was malfunctioning. Ø Ongoing coordination with Town’s attorney regarding prescriptive easement over the existing effluent sewer. Ø Ongoing onsite construction activities; CEI inspection logs and photos uploaded to Procore daily. Disinfecting has to be done between April 1 and Oct 30. There is a chlorine leak between the 2” small pipe to the large pipe at the water plant. Need to have the barn cleaned out so Bob and Jeff can get equipment in door. The air is not getting to the back flow due to Air Rot on the Piping. The floor needs to be cleaned from where the tanks leaked and flooded the water plant. Reach Alert: This is an alert system for the town. It will be a dollar per household. They can be notified by text, email and/or phone call. Alliance Rural Water Chad Reynolds talked about a system that they have that us part of our membership dues. This alert system would cost $.10 a household. If the alert is anything related to water, there is not cost. Chad is going to get us more information on this alert system. Council Vice President Jerry Lietz made the motion to table the alert system until the April meeting. Council Member Darwin Miller second the motion. Motion carried 3-0. Council President Cameron Emond: Tile at Shirley Mills. The tile needs to be fixed so that her yard will drain. The new tile will go between Mills and NIPSCO easement. Emond’s Excavating gave a quote of $2833.61. Council Member Darwin Miller made the motion to fix the tile at the Mills and NIPSCO easement. Council Vice President Jerry Lietz second the motion. Motion carried 3-0 Dormant Accounts Ordnance: There are several dormant accounts that need to be closed. All of these funds are at a zero balance. Janel Hofstetter asked if it would be difficult to reestablish these fund accounts if there was a need for them in the future. It is not difficult to reestablish a fund account if needed. Council and Board member training, Energy efficient savings program, and testing for copper and lead. Replace don’t Erase HB 1002 Ordnance: This bill will stop Business Personal Property Tax. If this bill is to passed it will take over one billion dollars in personal property distributions to the local units of government. White County stands to have decrease of 1,701,626.40 That is a 25.25% lose. The town of Wolcott stands to have a decrease of $113,717.96 at a rate of 17.6%. Motion carried 3-0 Utility Clerk Breanna Wood: Breanna would like to have access to the surveillance cameras. Deputy Marshal Jacob Baer asked Breanna to get a hold of Apex and get them set up for the computer. Resident George Mathew: Mr. Mathews lives on Homer Lane. There is a Low place by the fire hydrant. He is wondering if the tile didn’t break. Bob Thomas told Mr. Mathew that he would check it out. Deput Jarod Baer: Found a new truck for the Marshal’s office. There has been a new generator installed at the new lift station. Robert Thomas, Water Supervisor Need to move equipment to the leaf vac in the garage. Had a chlorine leak in the bulk tank at the water plant northeast corner. It should only take a week to run to install a new water line. Jacob Ahler, Town Attorney will have an easement agreement for the town at the next meeting. James Herre, Town Marshal Gave his monthly report. With the snowstorm coming in, James asked if the Wolcott Christian Church could be used as an emergency shelter? Pastor Tom Bennett said that whatever they need from the church that the church will make sure they have it. Darwin Miller, Council Member Asked James Herre who was responsible for the sidewalks in front of the Marshal Department? Darwin also asked who was responsible if someone should fall. Jacob Ahler said that the town would not be responsible. Kenneth Burns, Fire Chief on January 12,2022 there was a power surge at the Fire/Ambulance station. The Garage doors, Mother boards, and etc. were affected. Working with NIPSCO to try and get them to pay for the damages. Janele Hofstetter, KIRPC Head start is at KIRPC. They are desperate for Workers. George Blissett, Wolcott Main Street There are several projects being planned for the town. More details to come. They said that the only person signing checks should be the Clerk-Treasurer. Pamela Bennett, Clerk-Treasurer Mike’s tree service took care of a tree that was damaged in the storm. There will be one warning per year. After one warning there will be a $50.00, per offence, if it is not put away before dark. The senior Citizen Apartments can pull the Totes out of the easement. After the ordinance is passed there will be letter sent out to all residence of Wolcott. Marshal Herre asked if it would be better to start the newsletter back up for communication with residents. Motion carried 2-1 with Rex Pearson, Council Member objecting to the motion. All Cats and Dogs need to be registered with the town. Sterile cats and dogs have a fee of $3.00. Non altered animal is $5.00. Need to order signage for road and 911 for the Water and Wastewater plants.     Resolution 2022- Town of Wolcott, Indiana A RESOLUTION TO TRANSFER FUNDS OF THE TOWN OF WOLCOTT, WHITE COUNTY, INDIANA, FOR THE YEAR 2022 TO BALANCE FUNDS FOR COUNCIL ACTION PURSUANT TO IC 6-1.1-18-1 WHEREAS, certain extraordinary conditions have developed since the adoption of the existing annual budget for the year 2022, and it is now necessary to transfer appropriations into different categories than was appropriated in the annual budget and for the various functions of the several departments to meet those expenses; SECTION 1, Be it resolved by the Town Council of the Town of Wolcott, Indiana, that for the expenses of the town government the following appropriations are hereby transferred and set apart out of the funds hereinafter named and for the purposes specified subject to the laws governing the same, such sums are herein transferred unless otherwise stipulated by law.   • Resolution - Business Personal Property

    Wolcott Town Council RESOLUTION NO. 2022-3-3 RESOLUTION OPPOSING LEGISLATION REGARDING THE BUSINESS PERSONAL PROPERTY TAX WHEREAS, the Indiana legislature proposed changes to the depreciation floor and other aspects of Indiana’s business personal property tax as a priority in their 2022 legislative agenda; and, WHEREAS, Wolcott Town Council opposes all legislation that contemplates eliminating any portion of the personal property tax without permanent FULL replacement guaranteed by the state; and, WHEREAS, any contemplated revenue replacement must be a source of revenue that continues to grow over time just as a property tax base would in order to allow growing communities to meet the demand for services; and, WHEREAS, a permanent state tax credit applied to ALL proposed business personal property tax reductions, holidays, phase-outs, etc., could eliminate unnecessary burden on local government in order to continue building health Indiana communities; and, WHERAS, the personal property tax is a relied upon method for funding local government; and WHEREAS, for taxing units not at the caps, a reduction in the tax base could result in property owners paying more in residential property taxes. For those communities at the caps, any phase out of the business personal property tax means a loss in revenue for local units of government; and WHEREAS, Business Personal Property Tax distributions to local units of government exceed $1 Billion, including $ 1,701,626.40 in White County and which represents about 25.25% of White County’s property tax revenue; and WHEREAS, the Town of Wolcott in White County would lose an estimated $113,717.96 in tax revenues; that is an estimated 17.6% of the Town of Wolcott Property tax revenue and WHEREAS, significantly reducing the business personal property tax will have a dramatic impact on the Town of Wolcott’s ability to repay tax increment financing bonds because a significant portion of the revenue backing the bonds comes from personal property; and WHEREAS, The Tax Foundation 2022 State Business Tax Climate Index lists Indiana as number one ranking for property tax; and, WHEREAS, Indiana consistently ranks in the top states with an attractive business tax climate, yet a community’s quality of life is an increasingly greater influencer of business relocation and growth decisions: NOW, THEREFORE, be it is resolved by the Council of the Town of Wolcott that we oppose all legislation that contemplates eliminating any portion of the business personal property tax without full and permanent replacement guaranteed by the state.     RESOLUTION NO. 2021-____ RESOLUTION OF THE TOWN COUNCIL OF WOLCOTT OF WHITE COUNTY, INDIANA, ESTABLISHING POLICIE SAND PROCEDURES TO PROTECT DECORUM AND FOSTER THE EFFECTIVE ADMINISTRATION OF PUBLIC MEETINGS WHEREAS, the Town of Wolcott Council serves as the body of Wolcott, Indiana and WHEREAS, the Town of Wolcott Council conduct Town business during its regularly scheduled and, if necessary, special meetings, all of the which are open to the public; and WHEREAS, the Town of Wolcott Council previously adopted, and continue to follow, the general rules of parliamentary procedure as set forth in Robert's Rules of Order regarding the conduct and administration of its public meeting; and WHEREAS, the Town of Wolcott Council believe it is in the best interest of the Town, as well as those individuals who choose to attend public meetings of the Town Council, to adopt standard policies and procedures for the administration of public meetings to supplement or, as the case may be, in lieu of the parliamentary procedure set forth in Robert's Rules of Order; and WHEREAS, the policies and procedures adopted herein are intended to provide the general public with a clear and concise set of standards for public meetings held by the Town Council and, when applicable, rules regulating the conduct and decorum of members of the general public who wish to attend said public meetings; and WHEREAS, in order to protect generalmeeting decorum and foster more effective administration of public meetings, the Council now desire to adopt standard policies and procedures applicable to public meetings held by the Council accordingto the general parameters stated herein. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCILOF WOLCOTT OF WHITE COUNTY,INDIANA: 1. The Town of Wolcott Council hereby adopts the following rules which shall apply to all individuals attending public meetings of the Town Council of Wolcott Indiana: a. Members of the general public in attendance at a public meeting of the Town Council of Wolcott have no rights with reference to the meeting except other wise provided by law. b. Although members of the general public have no right to speak during a public meeting, the Town Council, at their sole discretion, may provide for a public comment period, during which time individuals may be given an opportunity to address the Town Council. c. During any public comment period, individuals wishing to speak will be required to sign a speaker registration sheet and provide the speaker's name, address, and issue or topic they wish to address. Individuals will be called to speak in the order of which they have signed the speaker registration sheet. d. Individuals who wish speak and have signed the speaker registration sheet may waive their opportunity to speak once called upon; however, an individual who waives their opportunity to speak will not be permitted to speak at a later time. e. Once called upon, all speakers shall first state their name, their address and the issue upon which they wish to speak. Speakers may only speak from a podium and must speak loudly and clearly f. Any speaker wishing to provide documents to the Town Council at the meeting shall provide one copy for each of the Town Council Members; however, speakers are encouraged to bring additional copies of any documents they intend to distribute during the meeting. g. Each speaker may only speak once and will be given a maximum of three (3) minutes to speak unless a shorter period of time is set forth by the Town Council at the start of the public comment period. Time may not be reserved or yielded to other speakers and once an individual is finished speaking, that individual's remaining time, if any, is waived. h. Each speaker will be notified when their allotted time to speak is exhausted and any speaker that does not immediately conclude their remarks at the expiration of their allotted time will be deemed out of order and the speaker will be asked to stop. i. Comments which are duplicative or repetitive will be deemed out of order and the speaker will be asked to stop. J. Any speaker who is discourteous, argumentative, accusatory, or insulting will be deemed out of order and asked to stop. k. Once a speaker is deemed out of order for any reason, that speaker's remaining time, if any, will be forfeited and the speaker will not be granted an opportunity to make any further commentor presentation. I. All members of the general public attending a public meeting will be expected to adhere to these rules and, any person failing to do so will be deemed out of order. m. The Town Council Members are authorized, and have sole discretion, to request any person deemed out of order leave the meeting and, once requested to leave, a person must immediately leave the meeting room. n. In extreme cases, if a person refuses to leave the meeting after being asked to do so and that person continues to disrupt the proceedings in a way is obviously hostile to the purpose of the meeting, the Town Council may order that the person be removed by members of the Wolcott Marshal’s office or White County Sheriff’s Department. o. During its public meetings, the Town Council will take all measures necessary under the circumstances to maintain order. In exercising this discretion, the Town Council will be guided by a judicious appraisal of the circumstances, including the conduct and decorum of members of the general public in attendance. 2. Upon the adoption of this Resolution, a copy of the rules stated herein shall be posted outside the Town Council Conference Room and made available to the general public through the internet website Wolcott, Indiana 3. 4. Wastewater Superintendent John Emond reported that larger structures are underway with the Wastewater Plant project. They are continuing to bridge between the old plant and parts of the new plant. John has weekly updates with issues and resolutions. Town Marshal James Herre presented his monthly report. Wayne Winkler is at the academy and Jared Baer is out temporally due to emergency surgery. Clerk Treasurer Pamela Bennett stated that the food drive will take place November 17th. Boxes will be pre made and ready to hand out to families. Janell Hofstetter has been in touch with Kirpc who is making a way for more grant opportunities. George Blissett reported Halloween went well. There will be an update coming soon pertaining to the plans with the Gas Station. They are working with Kirpc to get a grant for 2022. Council Member Jerry Lietz mentioned the BBQ food vendor that has been selling in town. George Blissett provided information pertaining to them and Joe Rogers added that the vendor needs to get a permit. Town Attorney Jacob Ahler stated that a job description is needed for State Board of Acts and for advertising of the position. The position needs to be legal work pertaining to the town and no private property. Council Vice President Cameron Emond advised the council to table the topic in order to have time to figure out the details. Council Member Darwin Miller made the motion to table the topic. Council Member Rex Pearson second the motion. Motion carried 4-0. Resident, Marilyn Young, asked about limb pick up. Water Superintendent Robert Thomas stated that he has started chipping and taking it to Bio Town. Resident, Baudilio Gonzales, advises other town residents to watch their belongings due to a recent stealing from his garage. Town Marshal James Herre has investigated the situation, but there is a lack of evidence. Marshal Herre took it upon himself to pull Mr. Gonzales into his office to continue the conversation in private. Resident, Karen Evans, spoke for Bruce Blume and another town resident about their yards flooding every time it rains. Water Superintendent Robert Thomas stated that a line for sup pumps and drains was put in years ago and free hookup was offered to residents. Some residents refused the service resulting in this current issue. Karen asked Robert to talk to the homeowners about what needs to be done. Robert also stated that two streets in town have been re-paved and that the extra asphalt was used to fill in pot holes by the gas station. Town Marshal James Herre presented his monthly report. The Wolcott Ambulance department would like to remind all residents to put their house numbers up on their houses. Fire chief Kenneth Burns reported that the Fire Department had to repair an exhaust fan. Michael Johnson reported on behalf of White County Economic Development that there will be a Welcome Home event for some veterans on October 16th in Monticello. George Blissett reported that the Mainstreet Oktoberfest went well. George also stated that they will be doing it again next year. Town Attorney Jacob Ahler announced that the contract allowing Comcast to do work in Wolcott, has been revised. Clerk Treasurer Pamela Bennett requested permission from the Council for her and Deputy Clerk, Abigail Ewen, to go to a conference in November. The office will be closed during these days. After little discussion, Council Member Jerry Lietz made a motion to allow Pam and Abby to go to conference. Council Member Darwin Miller second the motion. Motion carried 4-0. Council Member Darwin Miller asked Town Marshal James Herre if a previous discussion about a dog running around Town has been resolved. James clarified that the situation has been dealt with. Rob announced that the Dollar General project, as well as the hydrant project, would all be completed by the end of the week. Resident, Debbie Holder, informed the Council that she had been using her own water to water the flowers in the flower pots, along the highway. Debbie then asked the Council if it would be possible to give her an adjustment on her bill. The Council agreed and told Debbie that they would allow her to use the Town’s water to water the flowers next summer. Council Member Darwin Miller made a motion to give Debbie a bill adjustment. Council Vice President Cameron Emond second the motion. Motion carried 4-0. A concerned resident brought up the fact that their elderly neighbor needs some help taking care of their yard. The yard is being overtaken by weeds and overgrown grass. The Council then discussed asking for volunteers to help clean up the yard. Council President Michal Johnson stated that they would call Tri-County High School and alert the principal that seniors could use this opportunity as a way of getting their community hours. Council President Michael Johnson read Ordinance 2021-15 for approval. After some mistakes were found in the Ordinance, the Council decided to table the Ordinance until it is fixed. Council President Michael Johnson read Resolution 2021-16 for approval. Council Vice President Cameron Emond made a motion to approve Resolution 2021-16. Council Member Darwin Miller second the motion. Motion carried 4-0. Council President Michael Johnson read the agreement between the Town of Wolcott and Comcast to allow Comcast to do work in town. The agreement states that Comcast will be responsible for any damages done by them. Council Vice President Cameron Emond made a motion to approve the agreement. Council Member Darwin Miller second the motion. Motion carried 4-0. Council President Michael Johnson brought up the possibility of ending the live streamed meetings on Facebook, since the meetings are open to the public. The Town of Wolcott does not own the Wolcott, Indiana page on Facebook. Utility Clerk Breanna Wood stated that she will continue to take videos of the meetings and try to upload them to the Town website, as an alternative. After little discussion, the Council agreed to end the live stream. A resident brought to the Council’s attention that there are many dead trees in town that need taken care of. The resident expressed concern over the fact that these trees could fall and damage property and/or hurt someone. Another resident asked the Council if they receive monthly financial reports, and if not, why? The resident was told that Council does receive monthly reports, but some members admitted that they do not really pay attention to the reports sometimes. After much discussion, it was decided that moving forward, the Council will vote to approve monthly financial reports. Fire Chief Kenneth Burns announced that Fire Prevention Week is coming up and that the Fire Department will be visiting the school. Clerk Treasurer Pamela Bennett presented the 2022 Budget to the Council, after making some small changes to make it easier for everyone to read. Jared Baer expressed his concerns that remain over the budget. Town Marshal James Herre told the Council that his concerns do not lie within the overall budget, but that his concerns are over the line items in the budget. The Police Department wants to know why their budget for 2022 was shorted by $100,000 compared to previous years. Pamela explained that the Police Department is not losing any money because of the fact that there is so much money left over in their account from last year. Pam also stated that money that is currently existing in the account will not show up on the 2022 Budget lay out, which is why it looks as if the Police are not getting as much money. James Herre disagreed and stated that the extra money in the account does not transfer over to the Police account for the next year. Pamela explained to the Council that she cannot redo the budget, but that she can ask for a possible extension. A few residents expressed their concerns over the Police Department budget, and advised the Council to get their ducks in a row before approving the budget. After much discussion, the Council decided to table the budget. Council Vice President Cameron Emond made a motion to table the 2022 Budget. Council member Darwin Miller second the motion. Motion carried 4-0. Council President Michael Johnson read an agreement made between Comcast and the Council. The agreement states that if Comcast damages any property during their digging process, then they have to fix it. The Town will not be liable. Council President Michael Johnson announced that Council needed to make a decision on whether or not to allow the Oktoberfest to have a beer garden. Clerk Treasurer Pamela Bennett informed the Council that she could not find any ordinance pertaining to alcohol. Council Member Jerry Lietz made a motion to approve the beer garden at the Oktoberfest. Council Vice President Cameron Emond second the motion. Motion carried 3-0 due to Darwin’s nepotism. George Blissett, Mainstreet President, then presented Mainstreet’s proof of insurance for the event. Council Member Darwin Miller stated that he does not know how much longer he can volunteer to beautify the town. Darwin then suggested that the Council think about hiring a part-time person to take on the job. After little discussion, Council President Michael Johnson said that he would discuss the idea with Water/Street Superintendent Robert Thomas. To end the Public Hearing, many people expressed their appreciation toward the Wolcott Police Department for all that they do.
