  • Ordinance Amendment - Stormwater Assessment Fee

    ORDINANCE NO. 2017-12 AN ORDINANCE AMENDING THE BILLING CYCLE, FLAT ASSESSMENT FEE AND PARCEL CONSIDERATIONS OF ORDINANCE NO. 2013-03, AN ORDINANCE AMENDING THE STORMWATER ASSESSMENT FEE IN ACCORDANCE WITH WOLCOTT TOWN ORDINANCE NO. 2010-02, AN ORDINANCE TO ESTABLISH THE FEE TO PROVIDE REVENUE TO THE STORMWATER FUND WHEREAS, Indiana Code Section 8-1.5-5, et seq., allows municipalities to establish funding thereto, and that the Town of Wolcott has not previously established funding for storm water management, and to establish a means of providing revenue to said fund; WHEREAS, it is prudent of the Town of Wolcott establish a fund regarding same to effective resolve storm water collection and disposal and to update techniques and equipment as needed; including but not limited to, repair and replace storm and drainage tiles and pursue other endeavors related to the elimination of storm water from streets and properties; WHEREAS, it is the responsibility of the Town Council to review and establish the flat monthly fee to provide revenue for Storm Water Management on an annual basis or as often as necessary in accordance with the need to establish and maintain a Storm Water Fund. NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WOLCOTT, WHITE COUNTY, INDIANA (A) The flat, monthly per property parcel fee, for 2013 and thereafter until necessary to amend said rate. In accordance with I.C. Section 8-1.5-5-7, The Town Council of the Town of Wolcott establishes a Flat Monthly Fee of $2.00 for the year 2013 and each year thereafter, to provide revenue for the Storm Water Fund. As amended, said fee shall exclude farm ground parcels; be collected September 1, 2017 and monthly thereafter; and no fees shall be billed retroactively for any time prior to August 15, 2017. (B) If any section, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any Court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this Ordinance.   • Ordinance - Local Road & Bridge Fund

    ORDINANCE NO. 2017-18 AN ORDINANCE ESTABLISHING THE TOWN OF WOLCOTT LOCAL ROAD AND BRIDGE MATCHING GRANT FUND WHEREAS, the Town of Wolcott, White County, Indiana Town Council hereto now wishes to establish the Local Road and Bridge Matching Grant Fund, NOW, THEREFORE, BE IT HEREBY ORDAINED by the Town Council of the Town of Wolcott, White County, Indiana: SECTION I There is hereby established in the Town of Wolcott a fund for the deposit of any grant(s) awarded to the Town of Wolcott from the Indiana Department of Transportation pursuant to any Local Roads and Bridges Matching Grant Agreement (the "Grant Agreements") entered into between the Town of Wolcott and the Indiana Department of Transportation. Said fund shall be referred to as the "Local Road and Bridge Matching Grant Fund". SECTION II Monies deposited in the Local Road and Bridge Matching Grant Fund shall be expended with appropriations only for the purposes for which the grant was awarded under the Grant Agreements. SECTION III Any unexpended monies in said Local Road and Bridge Matching Grant Fund at the close of the Project (as described in the applicable Grant Agreement) that were received from the Indiana Department of Transportation shall be returned to the Indiana Department of Transportation in accordance with said Grant Agreement. SECTION IV The express or implied repeal or amendment by this Ordinance or any other Ordinance or part of any other Ordinance does not affect any rights or liabilities accrued, penalties incurred, or procedures begun prior to the effective date of this Ordinance. Those rights, liabilities, and proceedings are continued, and penalties shall be imposed and enforced under the repealed or amended Ordinance as if this Ordinance had not been adopted. SECTION V No part of this Ordinance shall be interpreted to conflict with any local, state or federal laws, and all reasonable efforts should be made to harmonize same. Should any section or part thereof of this Ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole, or any other portion thereof other than that portion so declared to be invalid, and for this purpose the provisions of this Ordinance are hereby declared to be severable.     TOWN OF WOLCOTT, INDIANA RESOLUTION NO. 2017-08 REPEAL OF BLIGHT DECLARATORY RESOLUTION of the TOWN COUNCIL OF THE TOWN WOLCOTT Whereas, the Town of Wolcott has addressed blighted conditions in the in the following area of downtown Wolcott that was designated as blighted as defined by Indiana Code 36-7-14 on December 16, 2008: Market Street from Burke Street to 3rd Street and US Highway 24, also known as Range Street, from North Street to Anderson Street. And whereas, the public infrastructure of sidewalks and street lights have been improved. Be it resolved by the Town of Wolcott that the previously passed Blight Declaratory Resolution for the aforementioned area is repealed.     TOWN OF WOLCOTT, INDIANA RESOLUTION NO. 2017-07 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WOLCOTT, INDIANA, AUTHORIZING THE SUBMITTAL OF THE BCP APPLICATION TO THE INDIANA OFFICE OF COMMUNITY AND RURAL AFFAIRS AND ADDRESSING RELATED MATTERS WHEREAS, the Council of the Town of Wolcott, Indiana recognizes the need to stimulate growth and to maintain a sound economy within its corporate limits; and WHEREAS, the Housing and Community Development Act of 1974, as amended, authorizes the Indiana Office of Community and Rural Affairs to provide grants to local units of government to meet the housing and community development needs of low- and moderate-income persons; and WHEREAS, the Town of Wolcott, Indiana has conducted or will conduct public hearings prior to the submission of an application to the Indiana Office of Community and Rural Affairs, said public hearings to assess the housing, public facilities and economic needs of its low- and moderate-income residents; NOW, THEREFORE, BE IT RESOLVED by the Council of Wolcott, Indiana that: 1. The Town Council President is authorized to prepare and submit an application for grant funding to address the clearance of the building at 129 West Market Street, and to execute and administer a resultant grant including requisite general administration and project management, contracts and agreements pursuant to regulations of the Indiana Office of Community and Rural Affairs and the United States Department of Housing and Urban Development. 2. The Town of Wolcott, Indiana hereby commits the requisite local funds in the amount of seventeen thousand eight hundred thirty-three dollars ($17,833), in the form of cash from the town’s Rainy Day Fund as matching funds for said program, such commitment to be contingent upon receipt of BCP funding from the Indiana Office of Community and Rural Affairs.   • Ordinance Amendment - Sidewalk Fund

    ORDINANCE NO. 2017-07 AN ORDINANCE AMENDING ORDINANCE NO 2015-07, AN ORDINANCE TO ESTABLISH A SIDEWALK FUND IN THE TOWN OF WOLCOTT, INDIANA WHEREAS, the Wolcott Town Council recognizes that the replacement, and/or rehabilitation of sidewalks within the corporate boundaries of the Town of Wolcott enhances the quality of life for all town residents; and WHEREAS, the Wolcott Town Council intends to assist residential property owners who live within the corporate boundaries of the Town of Wolcott, Indiana and either live in their dwelling, are current in their property tax payments and/or who cannot otherwise afford to replace or rehabilitate existing sidewalks that are hazardous to the public; and WHEREAS, the Town of Wolcott is desirous to establish a fund to be utilized by residential property owners with the Town of Wolcott to replace or rehabilitate existing sidewalks in partnership with the Town of Wolcott, whereby the property owner shall pay fifty percent (50%) of the total cost of removal, rehabilitation or replacement of existing sidewalks. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the Town of Wolcott, White County, State of Indiana, as follows: 1. The Sidewalk Program is hereby created in the Town of Wolcott. The Sidewalk Program shall be funded through the contributions of residential property owners in the town desiring to replace or rehabilitate public sidewalks adjacent to private property and from a local funding match appropriated from the Municipal Cumulative Capital Fund, as permitted for uses in IC 36-9-16-3, in an amount determined by the Wolcott Town Council on an annual basis. 2. Monies placed in the Sidewalk Fund shall not be withdrawn and/or expended except for the purposes for which the fund is created, namely the replacement and rehabilitation of residential sidewalks within the corporate boundaries of the Town of Wolcott, Indiana. 3. In the event that the Sidewalk Fund is dissolved, all remaining funds will be transferred to the General Fund as miscellaneous revenue. 4. The invalidity of any section, clause, sentence or provision of this Ordinance shall not affect the validity of any other part of this Ordinance, which can be given effect without such invalid parts or parts. 5.   • Ordinance - Utility Ready Fee

    TOWN OF WOLCOTT, WHITE COUNTY, INDIANA ORDINANCE NO. 2017-05 AN ORDINANCE TO ESTABLISH A “UTILITY READY FEE” WHEREAS, Indiana Code Section 8-1.5-3-8 requires that the Town of Wolcott, on behalf of its utility, establish rates and charges which will produce an income sufficient to maintain the utility property in sound physical and financial condition to render adequate and efficient service; and WHEREAS, the Town has the duty to its utility ratepayers to establish reasonable and just rates and charges for its utility services that are sufficient to maintain its utility property in a sound physical and financial condition in order to render adequate and efficient services. WHEREAS, in order to produce enough income to maintain the utility property physically and financially, the Town Council desires to implement a “Ready to Serve Fee” of TEN DOLLARS ($10.00) a month to property owners that have an inactive utility meter or meter pit. That said Ordinance shall apply to the following: 1. Owners of vacant lots in the Town of Wolcott that have a utility meter on said lot. 2. Owners of lots in the Town of Wolcott with structures that have a meter pit or utility meter that are inactive. That the Ordinance described above shall not apply to vacant lots and structures that are owned by an adjacent owner that has an active utility line. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WOLCOTT, INDIANA: Section 1. The above recitations are adopted as finds by the Town Council; and It is further ordered and determined that the Town of Wolcott hereby adopts as its policy that all lot owners in the Town of Wolcott shall be subject to the recitations above.   • Ordinance - Transfer of Funds to Park

    TOWN OF WOLCOTT, WHITE COUNTY, INDIANA ORDINANCE NO. 2017-03 AN ORDINANCE TO TRANSFER PRESCRIBED AMOUNT TO FUND IN NEED OF MONEY FOR CASH FLOW PURPOSES WHEREAS, Indiana Code Section 36-1-8-4 Permits the transfer of a prescribed amount, for a prescribed period, to a fund in need of money for cash flow purposes from another fund of the political subdivision if the Council finds it necessary to borrow money to enhance a fund that is in need of money for cash flow purposes WHEREAS, the Town of Wolcott desires to transfer funds from the Town’s “Cumulative Capital Development Fund” to the department of Park and Recreation Fund to ensure adequate funding for maintenance and repair of the Town’s Park and Recreational areas. WHEREAS, the Town desires to transfer said funds as follows: 1. Twelve thousand dollars ($12,000.00) from CCD/Other Capital Outlays, Account #402001441.000 to Park and Recreation/Repairs and Maintenance, Account #204001361.000 for repairs and maintenance improvements. 2. Three thousand dollars ($3,000.00) from the CCD/Sidewalks and Curbs, Account #402001441.011 to Park and Recreation/Other Capital Outlays, Account #204001441.012 for playground equipment. 3. Three thousand dollars ($3,000.00) from CCD Other Capital Outlays, Account #402001441.000 to Park and Recreation/Professional Services, Account #204001315.000 for professional services. WHEREAS, in conformance with I.C. 36-1-8-4 (3), the Town shall transfer all funds under this ordinance back to their original account prior to December 31, 2017 unless the town shall obtain an emergency six (6) month extension as permitted under I.C. 36-1-8-4. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WOLCOTT, INDIANA: Section 1.
