January 7,2020

Pamela Bennett Clerk-Treasurer announced that all meetings are going to be recorded.

 

Council Elect Jerry Lietz. Council Elect Cameron Emond and Council Elect Darwin Miller were sworn into Office by Pamela Bennett Clerk-Treasurer.

 

The Council of the Town of Wolcott met Tuesday, January 2,2019 at 6:00 P.M. in the Conference Room of the Wolcott Town Hall for its regularly stated meeting.

 

Council President Michael Johnson opened the meeting with the pledge to the flag.

 

Election of Officers for the Council of Wolcott: Council Member Cameron Emond Volunteered to be the Vice President of the Council. Council Member Darwin Miller made a motion to accept Council Member Cameron Emond as Vice President. Council Member Jerry Lietz second motion passed 5-0

 

President of the Council: Council Member Darwin Miller made a motion to elect Council President Michael Johnson as President. Council Member Richard Lynn Second Motion carried 5-0

 

Council President Michael Johnson read and Presented 1) Certificates of Elected Official of the Town of Wolcott on Compliance with municipal nepotism Policy Applicable to Contracting, and (2. Annual Certification of Elected Official to the executive of the Town of Wolcott on Compliance with Municipal Nepotism involving Direct Line of Supervision. All Council Members and the Clerk-Treasurer need to sign the certificates. All were signed by the Council and the Clerk Treasurer

 

Department Head Reports:

Chad Reynolds Wastewater and Stormwater Superintendent:  The new Wastewater plant is set to get bids next month. Will be doing a walk through with Robert Bellucci in the next couple of weeks.

Graveled an alley off of 4th street. In the next couple of weeks there will be street patching done.

Will be working on the street behind the elevator approx. in April.

 

Robert Thomas Water/ Street Superintendent: Nothing to report.

Marshal Herre: Handed out how many arrests, Traffic stops and Assistant?s was done for the month of Dec

Steve Young Ambulance Director: Nothing to report

Kenneth Burns: Nothing to report.

Sandra Miller WRDC: Going to need a new representative for the WRCD. There will be meeting Jan. 6th. At the Community Building Anyone is welcome. The next WRCD meeting will be Jan 10 at the school corp. building. Going to be the planning for the year.

Karen Evans: 6 New companies interested in the Commerce Park. Going to be starting construction on the sweetener plant in the spring. Work on 1100 has begun. Be careful in that area.

Pamela Bennett Clerk Treasurer: New contract with Nanette Whitmire for the Janitorial/cleaning of the town hall. The contract is for 200.00 a month. After little discussion motion made by Council Member Darwin Miller. Council Member Richard Lynn Second Motion carried 5-0.

Linda Bajzatt as the Clerk Consultant for $25.00 an hour. After little discussion Council Member Richard Lynn made the motion. Council Member Darwin Miller Second Motion Passed 5-0

Contract to Hire JSC Firm for training and consulting. Their fee is $70.00 an hour. After very little discussion. Council Member Richard Lynn made the motion to hire JSC. Council Vice President Cameron Emond second Motion Carried 5-0

Presented the agreement between the Town of Wolcott and Jacob Ahler, Attorney-at-Law, to provide Legal Representation of the Town Council of Wolcott for the year 2020. This was voted on at the December meeting. Only need the Council to sign the agreement.  Motion made to retain Jacob by Council Member Darwin Miller Council Vice President Cameron Miller second motion carried 5-0

Pamela Bennett Clerk-Treasurer and Breanna Wood Deputy Clerk will be going to Keystone Training Jan 14-16,2020 In Danville Indiana. The office will be closed.

I feel it would be beneficial to have the Payroll to have its own instead of coming out of the General. I would only Keep the amount of the payroll and whatever amount the bank says has to be in the account.  Jacob will write up the ordinance.

Would like to order a recording devise for the meetings. I found one at staples for 193.99. It would be easier than trying to write everything. After little discussion Council Member Darwin Miller made the motion Council Member Jerry Lietz second motion carried 5-0

I am totally out of storage space. Bob Thomas and Chad Reynolds have agreed to build a closet in the garage. After a lot of discussion Council Member Darwin Miller made the motion Council Member Richard Lynn second Motion Carried 5-0.

I have several unpaid bills for people that have moved out of town. I would like to use a system of letters. First notice will be asking them to pay the bill. Second notice will be for the bill to be paid in 30 days. Third will be a certified asking that it be in 30 days or it will be filed in small claims court.

After very little discussion Council Member Richard Lynn made a motion Council Member Darwin Miller Second Motion carried 5-0

Robert Bellucci Common Wealth: Has several invoices for approval. In the amount of $169,789.42 Council Member Jerry Lietz made the motion Council Member Darwin Miller second Motion carried 5-0

Approval of Minutes and/or Memoranda: December 3.2019 Council Meeting and December 17,2019 Special Meeting. Council Member Council Member Richard Lynn made the motion Council Member Darwin Miller Second Motion Carried 5-0

 

 

Old Business:

Water Development Fees: Jacob has found that we cannot waive or Grandfather in the ordinance that we have on file. It stands as it is for now. We can amend or adapt a new ordinance. This is in reference to the Carey Jordan situation. The legal issue is that the money goes toward the development of the water construction and maintenance for the water department. AIM has said that we cannot waive the development fees. The meter is already on the property. There was a lot of construction done to get the water to the meter that Carey is responsible for as well. After a lot of discussion. Council Member Richard Lynn made a motion to table this until they can gather information on amending or adopting a new ordinance. Council Member Jerry Lietz second motion carried 5-0

 

Renee? Ankers Building at 129 W Market: Silver Engineering sent a quote. The Council wants to get some more Bids. Tabled until a later date. This has been tabled until April. Council Vice President Cameron Emond made a motion and Council Member Darwin Miller second motion passed 5-0

 

Edwin Buswell K-IRPC:  Update on where we are on the wastewater project 5.6-million-dollar Grant. We were only offered 4.5 million dollars. He needed a signature from Michael to go forward. After much discussion Michael signed the form. Council Member Richard Lynn made the motion Council Member Jerry Lietz second Motion carried 5-0

 

New Business:

 Edwin Buswell K-IRPC: Needs approval from the Council for the Library Board for their Expansion project grant. The library would apply to the Indiana office of Community and Rural Affairs Public Facilities Program for funding assistance for the building addition. The Town of Wolcott is to take the lead on the grant.  Council Member Darwin Miller made the motion to take the lead. Council Member Jerry Lietz made the second Motion Carried 5-0

K-IRPC: Election of a representative to the Kankakee Iroquois Regional Planning Commission Board of Commission Board for the year of 2020. The active participation by board members is vital to the ongoing success of K-IRPC and allows us to better understand and address the needs of our member communities. According to the requirements of IC: 36-7-7, the town is allowed one representative on the K-IRPC board. Chad Reynolds Volunteered to be on the board

 

Declaratory Resolution: No. 2019-01:

A.      Establish and designate regular stated meetings (first Tuesday of the month) and a procedure for call Special Meeting of the Town Council. Council Member

B.       Authorize the Clerk-Treasurer to invest and re-invest any monies of the town in obligations authorized and, in the manner, provided for by IC 5-13-4-1; and

C.       Authorize the payments of on-going utility and prior contracted services necessary to secure discounts and avoid penalties. Council Member Richard Lynn Made the motion to accept these declarations Council Member Darwin Miller Second Motion Passed 5-0

 

Declaratory of appointments for Town representative for the year 2020 follows:

1.       Wolcott Town Council representative to the Wolcott County Area Plan/Zoning Commissions;

Council member Jerry Lietz

2.       Wolcott Town Council representative to the Remington Wolcott Community Development Corp.

Darwin Miller

3.       Wolcott Town representative to the Kankakee-Iroquois Regional Planning Commission.

Council Member Richard Lynn made the motion to Accept appointments. Council member Darwin Miller Second Motion carried 5-0

 

Declaratory to approve the memberships to the following Organizations:

1.       Indiana Association of Cities & Towns (IACT).

2.       Indiana Leagues of Municipal Clerks & Treasurers (ILMCT) and the International Institute of Municipal Clerks (IIMC).

3.       American Water Works Alliance

4.       Indiana Rural Water Alliance

Council Member Richard Lynn Made the motion to pay these dues. Council Member Jerry Lietz second Motion carried 5-0

 

  

Declaratory to decide if we want to say with these Companies

A.    The New Wolcott Enterprise as the Town?s primary newspaper.

B.      Bank of Wolcott as the Town?s primary depository.

Council Member Darwin Miller made the motion to Keep these two companies

Council Member Richard Lynn Second Motion carried 5-0

 

 

There was discussion about the walnuts again. It was said that Carey Jordan knew that the walnuts were put in the pile of leaves on purpose. Russell Emond was told to have told Carey. Mr. Emond said he never said anything about the walnuts. The Council and the Clerk Treasurer would like to apologize to Mr. Emond for causing him undo Anger Kevin Emond talked about how the manufacture said that the walnuts would not do damage to the leaf vac and that Cameron was due an apology. Council President Michael Johnson asked Chad Reynolds to check out what our manufacture says and get back to the Council.

 

Council Member Richard Lynn made the Motion to adjourn. Council Member Darwin Miller Second Motion Carried 5-0
