TOWN OF WOLCOTT COUNCIL MEETING

The Council of the Town of Wolcott met Tuesday, January 2, 2019 at 6:00 p.m. in the Community Room of the Wolcott Town Hall for its regular stated meeting.

Council Vice President Michael J. Johnson opened the meeting by asking all present to join in saying the Pledge of Allegiance.

Council Members Present

Council Vice President Michael J. Johnson, Council Members Fred A. Young, Stephen B. Schemerhorn and Richard A. Lynn.

In attendance were: Clerk-Treasurer Linda S. Bajzatt, Water & Street Supt. Robert Thomas, Wastewater Supt. Chad W. Reynolds, Town Marshal James M. Herre; Wolcott Volunteer Fire Dept. Chief Kenneth Burns, Wolcott Ambulance Service Director Steve Young and Town Attorney

Jacob A. Ahler. Also present were: James Wolf of the Monticello Herald Journal and Barbara Lawson, editor/owner of The New Wolcott Enterprise

Clerk-Treasurer Linda S. Bajzatt stated that it was necessary to hold annual election of Council officers. Council member Fred A. Young moved to elect Michael J. Johnson for the office of Council President; Council member Stephen B. Schemerhorn seconded the motion, and the motion passed with a vote of yea ? 3; nay ? 0.

Council member Richard A. Lynn moved to elect Stephen B. Schemerhorn for the office of Council Vice President; Council member Fred A. Young seconded the motion; and the motion passed with a vote of yea ? 3; nay ? 0.

Council President Michael J. Johnson read a letter of resignation from Council member Michael A. Yelton, effective December 17, 2018. Council member Fred A. Young moved to accept the resignation of Michael A. Yelton, with regret, with an effective date of December 17, 2018; Council member Richard A. Lynn seconded the motion; and the motion passed 3-0.

Council President Michael J. Johnson then stated that due to the resignation of Council member Michael A. Yelton, effective December 17, 2018, the Wolcott Town Council is accepting Letters of Interest to fill the vacated Council seat; all members of the Wolcott Town Council are currently at-large members.  Interested persons must qualify as per Indiana Code 3-8-1-27:  Council members must currently reside in the town, and must have been a resident of the town for at least one year before appointment by Wolcott Town Council. Letters of Interest must be received by the close of business (4:00 p.m.) on Friday, January 11, 2019.  Letters of Interest shall be mailed to: Town of Wolcott, Clerk-Treasurer?s Office, PO Box 38, Wolcott, IN  47995 or dropped off at the Wolcott Clerk-Treasurer?s Office, 101 West North Street, Wolcott, IN during business hours - 8:30 a.m.-4:00 p.m.

Council member Fred A. Young moved to schedule a Special Session on Tuesday, January 15, 2019 at 6 pm in the Community Room of the Wolcott Town Hall. Said meeting is to primarily open and review Letters of Interest for the vacated Council seat; Council Vice President

Stephen B. Schemerhorn seconded the motion; and the motion passed 3-0

Minutes/Memoranda

Council member Richard A. Lynn moved to approve the following minutes and/or memoranda:

Council member Fred A. Young seconded the motion, and the motion passed 3-0.

Departmental Reports

Wolcott Water & Street Supt. Robert G. Thomas reported that the telephone lines to the well and the well alarms were disrupted this past week for several days. The telephone company has corrected the problem.

Wolcott Wastewater Supt. Chad W. Reynolds stated that he too had disruption of alarm connections to the main lift station, most probably due to the amount of rain. He stated that the trucks and plows are ready for the snowfall. 

Wolcott Town Marshal, James M. Herre stated that he has received two quotes for the purchase and installment of cameras for his office, the Clerk?s office and outdoor perimeter of the town hall, but is waiting on clarifications from both companies. 

Wolcott Volunteer Fire Dept. Chief Kenneth Burn stated that his department will be staking the hydrants with markers for the winter weather this week. Chief Burns stated that the amount of children to visit with Santa Claus was significantly down. He stated that next year he hope there is better communications between the different groups planning winter activities. 

Clerk-Treasurer Linda S. Bajzatt stated that Breanna M. Wood of Wolcott area has been added to the Clerk-Treasurer?s staff, effective December 26, 2018. In keeping with the 2019 Town of Wolcott Employees Salary Ordinance schedule, Ms. Wood was hired in at $12.75 per hour.

 Robert Bellucci of Commonwealth Engineers Inc. reported on the Pre-Construction Meeting held before the Christmas holidays. He presented the following recommendations for formal award of bids for the Water Construction Project:

Division A ? Water Treatment Plant ? Reynolds construction, LLC for the base bid in the amount of $1,873,000.00; Council member Fred A. Young moved to award the Division A ? Water Treatment Plant bid to Reynolds construction, LLC for the base bid in the amount of $1,873,000.00; Council member Richard A. Lynn seconded the motion and the motion passed 3-0.

Division B ? Distribution System Improvements ? TGB Unlimited Inc. for the base bid in the amount of $1,546,021.20; Council member Richard A. Lynn moved to award the Division B ? Distribution System Improvements to TGB Unlimited Inc. for the base bid in the amount of $1,546,021.20; Council member Fred A. Young seconded the motion; and the motion passed 3-0.

Robert Bellucci then presented letters from Commonwealth Engineers, Inc. requesting approval and designation of Commonwealth Engineers, Inc. staff per recommendation of Robert Bellucci,,P.E., Commonwealth Engineers, Inc.in the Water Construction Project.  Council member Richard A. Lynn moved to approve the request and designation of Commonwealth Engineers, Inc. staff per recommendation of Robert Bellucci, P.E., Commonwealth Engineers, Inc.in the Water Construction Project; Council Vice President Stephen B. Schemerhorn seconded the motion; and the motion passed.  Council then signed USDA grant documentation relative to the above motion.

NEW BUSINESS

Council President Michael J. Johnson read Declaratory Resolution No. 2019-01 to:

A.    Establish and designate regular stated meetings and a procedure for calling Special Meetings of the Town Council

B.     Authorize the Clerk-Treasurer to invest and re-invest any monies of the town in obligations authorized and in the manner provided for by IC 5-13-4-1; and

C.     Authorize payments of on-going utility and prior contracted services necessary to secure discounts and avoid penalties.

Council member Stephen B. Schemerhorn moved to approve and adopt as read Declaratory Resolution No. 2019-01;  Council member Fred A. Young seconded the motion; and the motion passed 3-0. 

Council President Michael J. Johnson  presented the Agreement between the Town of Wolcott and Jacob Ahler, Attorney-at-Law, to Provide Legal Representation for the Town Council of Wolcott for year 2019. Council member Fred A. Young moved to approve the Agreement between the Town of Wolcott and Jacob Ahler, Attorney-at-Law, to Provide Legal

Representation for the Town Council of Wolcott for year 2019; Council member Richard A.

Lynn seconded the motion; and the motion passed 3-0. 

Council President Michael J. Johnson  presented a slate of appointments for Town representatives for the year 2019 as follows:

  Richard A. Lynn as Wolcott Town Council representative to the White County Area Plan/Zoning Commission; Council member Fred A. Young moved to approve the appointment of Richard A. Lynn as Wolcott Town Council representative to the White County Area Plan/Zoning Commission; Council Vice Stephen B. Schemerhorn seconded the motion; and the passed 3-0 with Richard A. Lynn abstaining;

  Stephen B. Schemerhorn asWolcott Town Council representative to the Remington Wolcott Community Development Corp.; Council member Richard A. Lynn move to approve the appointment of Stephen B. Schemerhorn asWolcott Town Council representative to the Remington Wolcott Community Development Corp.; Council member Fred A. Young seconded the motion; and the motion passed 3-0.

Council member Fred A. Young moved to approve the following slate of appointments for the year 2019:

  James M. Herre as Wolcott Town Marshal;

  Robert G. Thomas as Wolcott Street & Water Superintendent;

  Chad W. Reynolds as Wastewater & Stormwater Superintendent;  Kenneth Burns as Wolcott Volunteer Fire Department Chief; and,  Steve Young as Wolcott Ambulance Service Director.

  Council member Richard A. Lynn seconded the motion; and the motion passed 3-0.

Council member Fred A. Young moved to approve the following designations for the year 2019:

A.    Stated Council Meeting dates and times of the Wolcott Town Council as follows:

The Council of the Town of Wolcott shall meet the first Tuesday of each month at 6:00 pm in the Community Room of the Wolcott Town Hall, 101 West North Street, Wolcott, Indiana.

B.     The New Wolcott Enterprise as the Town?s primary newspaper.

C.     Bank of Wolcott as the Town?s primary depository.

Council member Richard A. Lynn move to approve the aforementioned designations; Council member Fred A. Young seconded the motion; and the motion passed 3-0. 

Council member Fred A. Young moved to approve the memberships in the following organizations:

?      Indiana Association of Cities & Towns (IACT).

?      Indiana League of Municipal Clerks & Treasurers (ILMCT) and International Institute of Municipal Clerks (IIMC).

?      Indiana Rural Water Alliance

?      American Water Works Association.

Council Vice President Stephen B. Schemerhorn seconded the motion; and the passed 3-0.

Council President Michael J. Johnson  read and then presented  1)Certifications of Elected

Official to the Executive of the Town of Wolcott on Compliance with Municipal 

Nepotism Policy Applicable to Contracting, and 2)  Annual Certification of Elected Official to the Executive of the Town of Wolcott on Compliance with Municipal Nepotism Policy involving Direct Line Supervision. Council President Michael J. JohnsonCouncil Vice President Stephen B. Schemerhorn,  Council member Fred A. YoungCouncil member Richard A. Lynn and Clerk-Treasurer Linda S. Bajzatt signed each document, respectively,  and presented the document to the Council President.

Council President Michael J. Johnson requested a nomination or volunteer for the seat of Wolcott Town representative to the Kankakee-Iroquois Regional Planning Commission. Chad W. Reynolds stated that he would gladly volunteer to be the Wolcott Town representative. Council member Fred A. Young moved to approve Chad W. Reynolds as Wolcott Town representative to the Kankakee-Iroquois Regional Planning Commission ; Council member Richard A. Lynn seconded the motion; and the motion passed 3-0.  Council thanked Mr. Reynolds for his commitment to this position.

Clerk-Treasurer Linda S. Bajzatt stated that she has not found Council approval of the Town of Wolcott Employee Handbook issued August 1, 2018. She stated that the contract was signed and fee paid to the human resource company, but found no formal approval of the completed handbook. All Council members & employees have received this handbook.  Council Vice Stephen B. Schemerhorn moved to approve and adopt the Town of Wolcott Employee Handbook issued August 1, 2018; Council member Fred A. Young seconded the motion; and the motion passed 3-0.

 Clerk-Treasurer Linda S. Bajzatt presented to the Council a request to renew the

Proof-of-Loss Service and updated appraisal of municipal buildings and property with Universal Valuation, Inc. at a renewal cost of $415.00.  After discussion, Council member Richard A. Lynn move to approve the renewal of services provided by Universal Valuation, Inc. as stated and at a renewal cost of $415.00; .; Council member Fred A. Young seconded the motion; and the motion passed 3-0.

Council discussed whether the abutting brick walls of the 129 West Market Street property were properly sealed.  After discussion, Council President Michael J. Johnson requested that the Clerk-Treasurer search and contact a firm that provides sealants on outside brick walls; contact information will be provided to Council Vice President Stephen B. Schemerhorn to follow-up with information.

Wastewater Supt. Chad W. Reynolds requested that the water, wastewater, streets and stormwater employees return back to it previous work hours of 7:00 a.m. to 3:30 p.m. Mr. Reynolds stated that with the wintry weather, the men need to be out earlier. The Clerk-Treasurer stated that with the business office open to the public until 4 p.m., there are times that the men are needed to turn off a meter, attend to an issue regarding streets, water, etc. Discussion ensued regarding the men alternating their hours ? one week one comes in early; next week the other comes in early; using flex time to cover the after-hours issues. After further discussion Council member Richard A. Lynn moved to approve the streets and utilities employees daily work hours to begin at 7 a.m. and end at 3:30 p.m.; Council Vice President Stephen B.

Schemerhorn seconded the motion; and the motion passed 3-0.
